2. Objet

Les présentes Conditions Générales de Vente régissent la vente d’œuvres artistiques imprimées sur aluminium et plexiglas de la série « Les Jardins d’Eden » de l’artiste Jean-Michel Crapanzano, proposées en éditions limitées à 15 exemplaires.

3. Caractéristiques des produits

 A. Les œuvres sont des impressions digitales haute définition réalisées sur aluminium et plexiglas.

Formats disponibles :

• 80 x 40 cm
• 120 x 60 cm

Chaque œuvre est produite en édition limitée à 15 exemplaires maximum, numérotée et livrée avec certificat d’authentification.

B. Publication édition française, 148 pages, format A4, édition limitée ( 50 exemplaires). ISBN: 978-9-08368-120-7
Prix: 80,00 + frais d'envoi.

4. Prix et évolution selon tirage (édition limitée)

Tarifs de base :

• 80 x 40 cm : 750€ TTC
• 120 x 60 cm : 1300 € TTC

Augmentation progressive :

Le prix augmente en fonction du numéro de tirage, comme suit :

• Exemplaires 1 à 5 : prix de base
• Exemplaires 6 à 10 : +10 %
• Exemplaires 11 à 15 : +20 %

Une fois les 15 exemplaires vendus, l’œuvre n’est plus disponible à la vente.

Les frais d’expédition sont à la charge du client.

Les publications sont a payer en totalité ainsi que les frais d'envoi.

5. Commande ( Toute commande est ferme et définitive après validation)

La commande est validée uniquement après :

• Réception du bon de commande complété et signé
• Paiement d’un acompte de 40 %

6. Modalités de paiement

• Acompte : 40 % à la commande
• Solde : 60 % avant expédition

Paiement par virement bancaire (ou autre moyen précisé).

7. Fabrication

Les œuvres étant réalisées à la demande, les délais et frais de livraison sont indicatifs et communiqués au client.

8. Livraison et transfert de responsabilité

Les livraisons sont effectuées via un transporteur tiers.

Clause essentielle :

Le transfert des risques s’effectue au moment de la remise au transporteur.

Le vendeur, Jean-Michel Crapanzano, décline toute responsabilité en cas de :

• Perte
• Vol
• Casse
• Retard

Le client doit :

• Vérifier le colis à réception
• Émettre des réserves auprès du transporteur
• Engager toute réclamation directement auprès du transporteur

9. Réclamations

Toute réclamation doit être formulée dans un délai de 48 heures après réception.

10. Droit de rétractation

Conformément aux législations applicables : les œuvres étant personnalisées ou produites à la demande, aucun droit de rétractation ne s’applique.

11. Droit d’auteur et propriété intellectuelle

Les œuvres sont protégées par les lois relatives au droit d’auteur, notamment :

• Code de la propriété intellectuelle
• Berne Convention for the Protection of Literary and Artistic Works
• Copyright Act
• Auteurswet
• Code de droit économique

Important :

• L’achat d’une œuvre n’entraîne aucun transfert de droits d’exploitation
• Toute reproduction, diffusion, modification ou usage commercial est strictement interdit sans autorisation écrite, toute violation pourra entraîner des poursuites judiciaires.
• L’artiste conserve :
• Le droit moral (inaliénable)
• Les droits patrimoniaux

12. Données personnelles

Les données collectées sont utilisées uniquement pour la gestion des commandes et restent confidentielles conformément au RGPD.

13. Droit applicable et juridiction

Selon la localisation du client, les règles suivantes s’appliquent :

• France : droit français
• Belgique : droit belge
• Pays-Bas : droit néerlandais
• Pays anglo-saxons : droit local applicable (Common Law)

En cas de litige :

• Une solution amiable sera privilégiée
• À défaut, compétence des tribunaux du lieu du vendeur

2. Purpose

These General Terms and Conditions govern the sale of artistic works printed on aluminum and plexiglass from the series “The Gardens of Eden” by artist Jean-Michel Crapanzano, offered in a limited edition of 15 copies.

3. Product Characteristics

A. The artworks are high-definition digital prints produced on aluminum and plexiglass.

Available sizes:

• 80 x 40 cm
• 120 x 60 cm

Each artwork is produced in a limited edition of a maximum of 15 copies, numbered and delivered with a certificate of authenticity.

B. Book, English edition, 140 pages, limited edition ( 50 copies)

Price: 80,00 euros + send costs

4. Pricing and Edition-Based Increase (Limited Edition)

Base Prices:

• 80 x 40 cm: €750 (incl. VAT)
• 120 x 60 cm: €1300 (incl. VAT)

Progressive Increase:

Prices increase depending on the edition number as follows:

• Copies 1 to 5: base price
• Copies 6 to 10: +10%
• Copies 11 to 15: +20%

Once all 15 copies are sold, the artwork is no longer available.

Shipping costs are borne by the customer.

5. Orders (All orders are final and binding upon validation)

An order is confirmed only after:

• Receipt of the completed and signed order form
• Payment of a 40% deposit

6. Payment Terms

• Deposit: 40% upon order
• Balance: 60% before shipment

Payment is made by bank transfer (or other specified method).

The book must be paid for in full; the discount does not apply.

7. Production

As the artworks are made to order, production times and delivery costs are indicative and communicated to the customer.

8. Delivery and Transfer of Responsibility

Delivery is carried out via a third-party carrier.

Essential Clause:

Risk is transferred at the moment the goods are handed over to the carrier.

The seller, Jean-Michel Crapanzano, declines all responsibility in the event of:

• Loss
• Theft
• Damage
• Delay

The customer must:

• Inspect the package upon receipt
• Submit reservations to the carrier
• File any claims directly with the carrier

9. Claims

Any claim must be made within 48 hours after receipt.

10. Right of Withdrawal

In accordance with applicable laws, as the artworks are customized or made to order, no right of withdrawal applies.

11. Copyright and Intellectual Property

The artworks are protected under copyright laws, including:

• The French Intellectual Property Code
• The Berne Convention for the Protection of Literary and Artistic Works
• The Copyright Act
• The Dutch Auteurswet
• The Belgian Code of Economic Law

Important:

• The purchase of an artwork does not transfer any exploitation rights
• Any reproduction, distribution, modification, or commercial use is strictly prohibited without prior written consent, any violation may result in legal action

The artist retains:

• Moral rights (inalienable)
• Economic rights

12. Personal Data

Collected data is used solely for order processing and remains confidential in accordance with GDPR regulations.

13. Applicable Law and Jurisdiction

Depending on the customer’s location, the following laws apply:

• France: French law
• Belgium: Belgian law
• The Netherlands: Dutch law
• Anglo-Saxon countries: applicable local law (Common Law)

In case of dispute:

• An amicable solution will be sought first
• Failing that, jurisdiction lies with the courts of the seller’s location
